Law 4640/2019 on mediation in civil and commercial cases contains provisions that regulate the manner of conducting the procedure. The existence of these provisions, however, does not negate its resilient and flexible nature, as the mediation process is determined by the mediator in consultation with the parties depending on the nature of the case.

The purpose of the proceedings, however, is best fulfilled when the particular circumstances of each case are taken into account and the real interests of the parties involved in the proceedings are served.

The mediation process is distinguished for its voluntary nature and usually begins with a joint meeting of the mediator with the parties, who, after being informed in detail by the mediator about the whole process, present their views on the difference between them.

This is followed by either joint or individual meetings between the Ombudsman and each party, in order for him to help the parties communicate with each other, conveying proposals and counter-proposals from one side to the other, but always with their consent.

At the end of the process the ombudsman draws up a record of reaching or not reaching an agreement, depending on whether or not the parties will reach a settlement of their dispute. The attorneys of the parties invited to mediation have a decisive role in the mediation process.

They are required to appear before their principals and provide them with legal advice, assist them throughout the process and draw up the final agreement, which will be reached by the parties.
